Successfully managing critical international patent filings under extreme time constraints for a leading medical equipment manufacturer.

Medical Devices | Global IP Strategy | PCT Filings

Client Overview

Our client is a well-established patent portfolio brokerage and consultancy firm specializing in intellectual property transactions, including patent sales, licensing, and strategic IP management. With an extensive client base in the technology sector, particularly in the digital wallet, online transaction, and e-commerce industries, the client focuses on helping businesses maximize the value of their intellectual assets.

Challenge

The client approached anovIP for an in-depth portfolio analysis of 1,670 US-granted patents in the fields of digital wallets, online transactions, e-commerce checkouts, and web advertising. The primary objective was to identify high-value patents within the portfolio that had strong potential for licensing or sale. However, the portfolio presented significant challenges, including

  • Large Volume: 1,670 patents spanning multiple technology domains required meticulous screening and analysis.
  • Diverse Technologies: The patents covered a broad range of technologies, each with distinct legal, technical, and commercial implications
  • Market Potential: Identifying patents that were not only strong in terms of innovation but also held commercial value or infringement potential was essential for monetization.
  • Infringement Identification: It was critical to screen for existing or potential infringers to assess the litigation risks and identify licensing opportunities.

Our Approach

At anovIP, we harness the expertise of our cross-disciplinary teams to deliver high-quality IP services. For this assignment, we utilized our comprehensive resources from various divisions, including Patent Analytics, Patent Licensing & Transaction, and Technology Transfer, to execute a detailed and structured analysis.

1. Detailed Reporting & Strategy Development

We provided the client with decision-making reports in two stages, each spanning three weeks. In each report, our team presented:

  • Comprehensive analysis of the portfolio, highlighting the highest value patents based on both technological merit and commercial potential.
  • Infringement analysis that outlined potential infringers and suggested which patents could be targets for licensing or enforcement.
  • Market insights: We assessed which patents had the most significant commercial viability based on current market trends in digital wallets, e-commerce, and online transactions.
  • Strategy for monetization: Our team also provided strategic recommendations for managing and monetizing the portfolio, including:
    • Prioritizing patents for licensing or sale based on their commercial readiness.
    • Identifying potential buyers or licensees within the fintech, e-commerce, and digital payment industries.
    • Mapping out a litigation strategy for patents with high infringement potential, should the client decide to pursue enforcement.
2. Infringement Screening & Risk Assessment

Our Patent Analytics division then performed a detailed infringement screening on each patent to identify potential infringers in the market. Using a combination of patent databases and proprietary tools, we assessed whether the patents had been cited by competitors or whether they overlapped with existing patents in key markets.

  • Invention Conceptualization Stage: Patents that were still at the idea stage and not yet fully developed.
  • Prototype Stage: This process helped us trace each element of the claim to its corresponding component in the accused product, identifying potential literal infringement.
  • Not Yet Commercialized Stage: Patents that were commercially viable but had not yet been exploited in the market.

This classification helped the client assess the commercial readiness of each patent and its likelihood of being licensed or sold.

3. Portfolio Segmentation & Filtering

We began by segregating the patents into multiple stages of analysis. Our Patent Analytics team, leveraging cutting-edge patent analysis tools and methodologies, filtered patents using key parameters, including:

  • Life Pendency: Identifying patents that were in the later stages of their lifecycle versus those with potential for extension or renewal.
  • Priority Year: Highlighting patents with recent filings, which were more likely to be of current technological relevance.
  • US Classification: Categorizing patents based on their technical classification to identify those that had the highest relevance to current market trends.
  • Inventor Group: Assessing patents based on the inventors behind them, identifying potential collaborations or licensees within relevant sectors
  • Prosecution Length: Filtering patents that had long or complex prosecution histories, which could indicate strength or potential litigation risk.
4. Ongoing Strategic Counsel

In addition to the portfolio analysis, our Patent Licensing & Transaction team provided strategic counsel to the client on the best way to manage and approach the patent sales or licensing negotiations. We crafted pitch decks, infringement charts, and competitive analyses that the client could use in outreach to potential buyers or partners.
