PCT National Phase Entry
Deadlines: 30 months from the priority date. Reinstatement after missing 30 months permitted under PCT Rule 49.6 on a "due care" standard.
Documents: Application request along with Thai translation of Specification (description, claims, any text of drawings, and abstract). If amended, both as filed and as amended must be provided. notarized or certified Power of Attorney required if applicant is not resident, statement of applicant's right to apply if the applicant is the inventor; otherwise deed/assignment or other evidence of right per PCT Rule 51bis.
Priority Document: Must be filed at the WIPO. Accepts domestic requests for restoration under Rule 49ter with "due care" with fee.
Conventional Priority Entry
Deadlines: Within 12 months from the earliest priority (basic application) date. Limited extension possible.
Documents: Patent application on Form 001-Kor with Thai translated specification (title, claims, abstract, and drawings if any); applicant and inventor details, notarized or certified POA required for representation, statement of Applicant's Right (if inventor is applicant) or Deed of Assignment when applicant differs from the inventor within 90 days of Thai filing.
Priority Document: Request for Priority Claiming 002-Kor along with Certified copy of the priority document within 16 months from the priority date.
Petty Patent (utility model)
Deadlines: Can be filed directly (including claiming Paris priority within 12 months) or converted from a patent application before grant/publication with a conversion fee.
Documents: Request on forms include 001-Kor (application), or 004-Kor (conversion), with title, features/objectives, detailed description, claims, and drawings filed in Thai. Notarized or certified PoA,
Priority Document: Certified priority document and evidence of right must be filed with Thai translation.
Other Requirements
Languages: Filing language is Thai; Applications must include specification in Thai, including drawings/sequence listings as applicable. Late submission of Thai translations within 90 days from the Thai filing or national phase entry is allowed. Any supporting foreign-language documents (e.g., priority documents, assignments) should be accompanied by Thai translations.
Power of Attorney: Notarized Power of Attorney is required to appoint a Thai agent for foreign applicants. Must be filed within 90 days from filing or national phase entry.
Declaration of Inventorship/Assignment Deed: Either a Statement of Applicant's Right when the inventor is the applicant or a Deed of Assignment when the applicant differs. Scanned copies are accepted at filing with late submission permitted within 90 days from filing upon request. Translation in Thai must be filed.
Family Patent Information: No such requirement.
Substantive Examination Request: Substantive examination must be requested within 5 years from Thai publication
Patent Validity: Patents have a 20?year term from the filing date (or the international filing date for PCT). Petty Patent is valid 6 years from filing, and extendable twice by 2 years each (maximum 10 years) upon timely extension requests and payment.
Annual Maintenance: Annuities are payable only after grant starting at the 5th year counted from filing. A 60?day due window opens at the beginning of each term. Lump?sum payment for years 5–20 is available. A 120?day grace period after the ordinary 60?day window is available with a surcharge, and if Patent cancelled for non-payment, a final 60?day restoration opportunity exists upon showing necessity.
Working Statement: Does not require working statement.
