As per section 4 of the Trademarks Act, 1999
The Registrar in writing can withdraw or transfer any pending matter before him to another officer, and it is his discretion to decide if the subject is to be dealt either de-novo (from the beginning) or, from the stage from which it was withdrawn or transferred.
Powers of Registrar
As per Section 127 of the Trademarks Act, 1999a. The Registrar can accept evidence presented by parties involved in a trademark registration case.
b. The Registrar has the authority to administer oaths to witnesses and parties providing evidence.
c. The Registrar can compel witnesses to attend proceedings to provide their testimony.
d. The Registrar can require the discovery and production of relevant documents from the parties involved
e. The Registrar can issue commissions to examine witnesses, which allows for the taking of witness testimony outside of formal proceedings
f. The Registrar has the authority to review his own decisions, though this review must be requested within one month of the original decision.
As per Section 128 of the Trademarks Act, 1999
The Registrar has discretionary powers for various issues but must ensure that all parties are given a fair chance to be heard before making decisions that could negatively affect them.
As per Section 129 of the Trademarks Act, 1999
The Registrar can accept evidence via affidavit but may also require oral evidence if deemed necessary.
As per Section 131 of the Trademarks Act, 1999
The Registrar can grant extensions of time at his discretion when an application with the prescribed fee is submitted, with no appeal allowed for such extensions.
