What is a Certification Trademark?

A certification trademark is a mark through which consumers can identify the originality and authentication of the product or services provided to them. It specifies to the consumer that a product or service qualifies for certain standards or has individual characteristics ascribed to it. The mark confirms that a product complies with all rules and regulations set by the proprietor of the mark. Any proprietor of a business using a certification trademark for its goods or services can assure its customers that the products or services provided by them are of high quality, adhere to standards, and have proper documentation for the same.


Section 2(1)(e) of the Trademark Act, 1999

A certification trademark is defined under section 2(1)(e) of the Act as a mark capable of distinguishing the goods or services in connection with which it is used in the course of trade that is certified by the proprietor of the mark in respect of origin, material, mode of manufacture of goods or performance of services, quality, accuracy, or other characteristics from goods or services not so certified and registerable as such under Chapter IX in respect of those goods or services in the name, as proprietor of the certification trademark, of that person.

Purpose and Usage of the Mark

A certification mark is used to represent the origin, standard, or quality of the product, which can be used by anyone who is adhering to the standards of the mark defined by the owner of the certification mark.

The certificate trademark is used as an instrument of standardization for particular goods or services, whereas the collective trademark is used to represent an association of people providing goods or services and to distinguish the same from other associations. For example: woolen clothes bearing WOOLMARK indicates that the cloth is made of 100% wool; any gold or silver jewelry bearing HALLMARK represents that the jewelry is made from pure gold or silver; any electronic appliances or industrial products having ISI Mark ensures a certified product.

Certificate trademark can be used by any individual irrespective of the proprietor of the mark. The proprietor of the certification trademark is not allowed to use the mark for its own goods or services; perhaps it authorizes others to use the mark and checks whether the mark has been used as per the standards regulated by the proprietor.


Conditions for filing Application of Certification Trademark

1.  An applicant must file an application before the registrar under the class of goods or services for which the mark is certified.

2.  As per Section 71 of the act, every application must be followed by a draft of regulations that is enclosed with provisions related to the authorized use of the mark, the applicant's authority to supervise the certification scheme, and the method of regulating the use of the mark.

3.  As per Rule 138 of the Trademark Rules of 2017, the applicant must provide a statement of case along with the regulations that describe the grounds for filing an application, i.e., the reason behind why an applicant is entitled to be the registered proprietor of the certification trademark.


Grounds of Removal of Certification Trademark

1.  If the registered proprietor, in respect to which the application that was filed, is no longer competent to certify the goods or services

2.  If the proprietor fails to observe or secure the regulations governing the usage of the certification mark

3.  If the certification trademark no longer provides advantage to the public for which it was registered.

In the case of Tea Board, India v. ITC Limited, C.S. No. 250 of 2010, the plaintiff Tea Board of India filed a trademark infringement suit against ITC Ltd. for using the name "Darjeeling" for their refreshment lounge in Kolkata as "Darjeeling Lounge". The highlighted issues were, whether the plaintiff has any other right on "Darjeeling" than certifying others to use it as a certification trademark for tea and whether the defendant with malafide intention has started using the name "Darjeeling" for their lounge services or to deceive public that it is associated with the plaintiff? The Court opined that the plaintiff has registered their certification trademark under Trade and Merchandise Marks Act, 1958 only in respect to goods and not for services. It was stated by the court that with respect to certification trademark, rights are very limited unlike regular trademark. The plaintiff has acquired certification trademark on "Darjeeling Tea" with respect to goods only and has no exclusive right on the word "Darjeeling". It was adjudicated by the court that the plaint presented by the plaintiff was beyond the time limit of 5 years and has violated the section 26 (4) of Geographical Indication Act. The court held that the defendant has not infringed any right of the plaintiff by using the name "Darjeeling Lounge" with respect to lounge services and there is no likelihood of confusion amongst the public.

It is to be concluded that certification trademarks are essential for consumers to know that goods and services provided to them by manufacturers have maintained certain standards. A certification trademark can be used by any business proprietor who is dealing in goods or services and adheres to regulations for which the registered proprietor has applied and has governed regulations in respect to the usage of the certified mark. It is clear from the above-mentioned case that the certification trademark is different from the regular trademark; the proprietor of the certification trademark cannot claim exclusivity on the word or any name and does not have any right other than certifying others to use the mark.

CHAPTER V - OPPOSITION PROCEEDINGS TO GRANT OF PATENTS

The Indian Patents Act, 1970 provides a robust opposition framework that allows third parties to challenge patent applications and granted patents to ensure only valid inventions receive protection. Section 25 establishes two forms of opposition—pre-grant opposition, which may be filed by any person before a patent is granted, and post-grant opposition, which can be filed by an interested person within one year of grant. These proceedings help prevent wrongful patent monopolies, encourage transparency, and safeguard public interest by scrutinizing novelty, inventive step, patentability, disclosure requirements, and compliance with statutory obligations. CHAPTER VI - Anticipation

Anticipation is a fundamental concept in patent law that determines whether an invention is truly novel and eligible for patent protection. Under the Indian Patents Act, 1970, an invention may be anticipated if it has been publicly disclosed, published, claimed, or used before the filing or priority date of the patent application.
